Mediation to the rescue

Senior advocate Firoze Andhyarujina has been included in the panel of arbitrators and conciliators of the Bombay High Court. The legal professional is mainly engaged in litigation practice concerning tax matters and company law. International Tax Review, World Tax 2006, has rated Andhyarujina amongst the five leading individual tax counsels in India.         Firoze Andhyarujina     Andhyarujina told Parsiana on September 26 that the Mediation Bill 2023 passed this month is the country’s first standalone legislation that provides an option to litigating parties to resolve disputes of commercial or civil nature through mediation. "There is a lot of litigation in the country…Parties who so wish, can settle disputes through arbitration… Normally arbitrators on the panel are retired judges… Sometimes specialists are appointed…If it is financial matter, the arbitrator could be a chartered accountant,” he said. The arbitrators have to be "acceptable” to both parties, he stated. There will always be an odd number of arbitrators for a particular case, he ended. ...
