Their Candied Cream will continue to titillate palates, as will Nescafe, Rose Ripple, Apricot and a host of other flavors of reasonably priced ice cream that the patrons of K. Rustom and Company have come to love over the eight decades of its existence. The parlor at Churchgate located in the North Stand of the Brabourne Stadium has obtained relief from the Small Causes Appellate Court staying an order that directed it to vacate and surrender its premises to the Cricket Club of India (CCI). The owners will have to deposit an interim monthly compensation of two-and-a-half lakh rupees in court till final disposal of its appeal, noted The Times of India (ToI) on July 7, 2022. The Small Causes Court had earlier this year ordered the eatery to vacate its premises within two months (see "Rustom’s meltdown,” Events and Personalities, Parsiana, June 7-20, 2022). Senior partner Rodabe Irani had appealed to stay the execution of that April 2022 order. The July order was passed by Judges M. S. Pathan and Jagdale, noted ToI.

The grant of the stay was opposed by CCI, stating that a valid decree had been passed in its favor, noted ToI. CCI said "the property is situated in the Churchgate area where rents are on the higher side…If the Court is going to stay the order, an appropriate compensation must be granted.”
The judges suggested that until Rustom places a valuer’s report on record, on the basis of evidence before them, they would draw a "golden mean figure of compensation,” stated the news report. Both Rustom and CCI agreed to this "stopgap arrangement” on an interim basis. The owners of the parlor have been directed not to create third party interest in the premises.
